In a notable consumer class action, pending in Federal Court, CPM represents a homeowner who was pursued by a debt collector, Pro Solutions, for unpaid Homeowners Association (HOA) dues. The complaint alleges that Pro Solutions violated the Fair Debt Collection Practices Act and other laws by attempting to collect fees and charges that were greater than those allowed by law, and engaged in other illegal debt collection activity. CPM, and co-counsel HERA won a significant victory when the Court denied Pro Solutions’ motion to dismiss and found that Plaintiff had met her burden of showing illegal fees. Homeowners who become even a few months late on their HOA dues can find that they are being charged thousands – unfortunately, many cannot meet the demands of the HOA collections companies and lose their homes.
