Cotchett, Pitre & McCarthy is investigating the Live Nation data breach from its subsidiary Ticketmaster, which was confirmed by Live Nation in an SEC filing on May 29, 2024.
Live Nation said in their 8-K filing that on May 20, 2024 that there was “unauthorized activity” in a third-party database containing customer information. On May 27, 2024, a “criminal threat actor” offered what was alleged to be Ticketmaster user data for sale on the dark web. The data breach was first disclosed to the public when hacker group ShinyHunters listed for sale the private information of 560 million Ticketmaster customers. The data compromised includes at least the names, addresses, phone numbers, order information and partial payment card details.We believe Live Nation and Ticketmaster have not complied with FTC cybersecurity guidelines for companies to protect personal information, which includes encrypting information stored on computer networks, understanding their network’s vulnerabilities, and using an “intrusion detection system to expose a breach as soon as it occurs.”
In May 2024, the U.S. Department of Justice sued Live Nation over the 2010 agreement clearing its purchase of Ticketmaster. The lawsuit alleges that Live Nation and Ticketmaster have used their power over concert venues and performers “to insert themselves at the center and the edges of virtually every aspect of the live music ecosystem.” With its vast market power and considerable resources, Live Nation could have deployed security systems and taken other steps to ensure that its customers’ data was safe, but it failed to do so.
