CPM Investigating the Delay of Apple's Rollout of Apple Intelligence on iPhone 16 Models
Cotchett, Pitre & McCarthy, LLP (CPM) is exploring a class action lawsuit against Apple, Inc. regarding Apple’s promises to consumers relating to the rollout of “Apple Intelligence,” Apple’s suite of artificial intelligence (AI) features on iPhone 16 devices. CPM is exploring materially false and misleading statements made by Apple and directed to iPhone users regarding Apple Intelligence’s functionality that consumers may have relied on to buy or upgrade to iPhone 16 devices.
On June 10, 2024, Apple publicly announced Apple Intelligence and launched an aggressive marketing campaign to promote the generative AI capabilities on iPhone 16. The marketing campaign included celebrity endorsements and highlighted the iPhone 16’s groundbreaking AI features and advanced Siri functions – only some of which became available to users after October 28, 2024. Rollout of remaining promised features never occurred, and Apple acknowledged on March 7, 2025 that fully-promised Apple Intelligence functionality may not be available until 2026.
