Alexander E. Barnett

Alex Barnett is a Partner at CPM where he specializes in class actions involving: antitrust and securities law violations; consumer fraud; negligent product design and manufacture; wage and overtime disputes; civil rights violations; and violation of environmental laws. He also handles mass tort litigation.

Alex is the immediate Past President of the Committee To Support Antitrust Laws (“COSAL”), which was established in 1986 to promote and support the enactment, preservation and enforcement of a strong body of antitrust laws in the United States. It is the only organization in Washington, D.C. dedicated to lobbying for strong antitrust laws and effective private enforcement.  He also serves as the Chair of COSAL's Antitrust & Climate Change Committe.  In addition, Alex serves as the Vice Chair of Public Justice's Food Network, which is aimed at addressing structural and institutional inequities in the food system.

Alex served as panel speaker at the 1st Annual National Class Actions Symposium (Osgoode Hall Law School, Toronto, Canada) and at the 3rd Annual Class Actions for Non-Class-Action Lawyers - Growing Your Business by Understanding the Basics and Recognizing Opportunities (hosted by Los Angeles County Bar Association). 

Alex was named to the Lawdragon list of 500 Leading Plaintiff Financial Lawyers and, along with CPM partners Adam Zapala and Elizabeth Castillo, received the American Antitrust Institute’s Outstanding Antitrust Litigation Achievement in Private Law Practice Award.

Representative class action cases include:  

In re Domestic Airline Travel Antitrust Litigation, (MDL No. 2656) where CPM represents plaintiffs in an action alleging a conspiracy by the four largest commercial air passenger carriers in the United States to fix, raise, maintain, and/or stabilize prices for air passenger transportation services within the United States, its territories and the District of Columbia in violation of Sections 1 and 3 of the Sherman Antitrust Act (15 U.S.C. §§ 1, 3).

In re LIBOR-based Financial Instruments Antitrust Litigation, (MDL No. 2262), wherein CPM represents more than a dozen public entities including the UC Regents, San Diego Association of Government, the County of Sacramento the Counties of San Mateo and San Diego, the Cities of Richmond and Riverside, East Bay Municipal Utility District, and others who invested in financial instruments with interest rates that were set to the London Interbank Offered Rate, or LIBOR. The complaints allege that the Defendant banks conspired to suppress LIBOR, both to reduce the amounts they were required to pay on LIBOR-based transactions, and to increase their perceived credit strength in the market.

In re Generic Pharmaceuticals Antitrust Litigation, (MDL No. 2724) in which CPM represents end-party payors alleging price-fixing by manufacturers of generic pharmaceuticals.

In re Broiler Chicken Antitrust Litigation, Case No. 1:16-cv-08637 (N.D. Ill.) in which CPM serves as co-class counsel on behalf of all indirect purchasers of broiler chickens. The case alleges that the defendants, companies comprising the production of 98% of the chicken meat produced in the United States, conspired to fix prices for chicken, by agreeing to restrict production to increase prices.

In re: Lumber Liquidators Chinese-Manufactured Flooring Products Marketing, Sales Practices and Products Liability Litigation, (MDL No. l:15-md-02627 (AJT/TRJ)) in which CPM represents consumers alleging that laminate wood flooring purchased from Lumber Liquidators was not compliant with applicable safety standards and was improperly marketed as meeting such standards.

Community Involvement

Alex and his wife are active participants in the multiracial family community, and have served as speakers for and supporters of various organizations (including LovingDay.org) dedicated to fostering understanding and acceptance of multiracial families. They also founded a stuffed animal company; through that entity, they donated thousands of newly-made stuffed animals to children in New York City’s Homes for the Homeless program.

Alex is on the Advisory Council of Rescuing Leftover Cuisine (RLC), a national 501(c)3 non-profit food rescue organization, operating in 16 cities and headquartered in New York City, that provides solutions to prevent excess wholesome cuisine from being wasted. RLC provides services such as food waste consulting, excess food delivery, co-branding services, and tax credit assistance. 

In addition, Alex has served as a volunteer for the following organizations: K.E.E.N. (Kids Enjoy Exercise Now), an organization dedicated to developing the athletic skills of disabled children; New York Cares, an organization that provides volunteer assistance to charities and non-profit organizations throughout the Metropolitan New York area; D.C. Cares, an organization that provides volunteer assistance to charities and non-profit organizations throughout the Washington, D.C. area; and A Broader Image, Inc., a Washington, D.C. non-profit organization that provides Internet access and other technology-based educational tools to children in inner-city schools.
